* NTE and HL were developed in 2015 and 2019 and have SHHA defined in the covenants for paying dues only. This was a deal with the developer (Scott Patrick Homes) and negotiated by SHHA. If developer, NTE and HL, didn't agree, SHHA would not take on the responsibility of accepting any ACC applications to review. This is backwards from the other UNITS that have dues optional and choose.
* UNITS 8C, 23, 26 - There's an issue to why these UNITS have mandatory dues. Residents believe it may not be accurate and have asked what is the legal document that makes this true. SHHA mandating dues without due legal process is extortion. Residents have a right to know.
Current Bylaw Section 7.5 Special Status of Architectural Control Committee.
Although the Architectural Control Committee is herein defined as a Standing Committee of SHHA, it is also a separate entity deriving its powers from the various Units’ Declaration of Restrictions, dating to the direct transfer of responsibilities from the prior ACCs. It should be understood that should SHHA (for unknown reasons) cease to exist, the ACC would continue to exist.
