There are 38 Unit Covenants within Sandia Heights Boundaries.
UNDERSTANDING THE COVENANTS
(items in blue are the verbiage from the Unit covenants, Search your Unit for the same wording)
Having 38 different covenants IS NOT a bad thing. In fact, this diversity makes each Unit have uniqueness and independence. For instance, those who live in more dense part of SH have different needs and covenants than what may be wanted in the more open-spaced areas. Unit covenants remain voted on by the individual Unit lot owners, not the entire 2200+ members, as it should be.
The Covenants are the authoritative documents that govern Sandia Heights.
Land owner - property owners have the rights in the covenants. All the reservations and restrictions hereinafter set forth are made for the benefit of each and every subsequent owner of any portion of the land in said Subdivision
SHHA is not the authority on the covenants. SHHA is a created entity used by residents to help enforce the covenants.
If SHHA is dissolved, the covenants remain.
In the covenants, an ACC is established. An Architectural Control Committee (hereinafter called the Committee) is hereby established......
Any Unit can re-write their covenants. Most units require the Unit members to have 3/4 of the Unit members to change the covenants, some are different. .....the then record owners of a three-quarters majority of the residential lots in said Sandia Heights South Unit X agree to change said covenants in whole or in part.
ACC does not have the authority to change, modify, interpret the covenants without Unit approvals.
ITEMS NOT PART OF THE COVENANTS
Dog barking complaints are not in the covenants. This is not covenant enforceable. Call the BernCo Animal control.
Rules against mature trees and enforcing them to be cut down are not in the covenants.
Parking on the street is not illegal. Covenants do not have anything about street parking. Best thing to do is put efforts into changing the unit covenants.
Having several cars at one home is not illegal. Residents can have several cars on their lots.
Wildlife, animal rescue is not in the covenants. Tending to wildlife is the BernCo wildlife, game and fish dept. responsibility.
Any ACC application approved gives the lot owner the "OK", even if it's a set-back covenant violation or xeriscape. If a home has these, YOU should be upset at the ACC for allowing it. ACC violated your covenants. This is why ALL applications, approved and not approved, should be listed in the GRIT.
